The City Council notes the Inspectors decision to allow the appeal
The Council’s opposition to the case was supported at the Inquiry by the West Midlands Combined Authority and the West Midlands Rail Executive. However, the Inspector was presented with additional information during the course of the Inquiry and came to a different conclusion about the potential risk to the delivery of the South West Camp Hill Chord than the Council had. Even so, the Inspector concluded that there is no definitive evidence either way to say conclusively whether the scheme would or would not prejudice the delivery of the Chords and in those circumstances acknowledged that the Council’s decision to refuse planning permission was not unreasonable.’
